Aura Platform – Terms of Use

Welcome to the Aura Platform (“Platform”). These Terms of Use (“Terms”) govern your access to and use of the Platform, including our website at aura.med and our application available on app.aura.med (together, the “Services”).

By registering an account, clicking “I agree,” or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Company Identification

The Platform is owned and managed by:

1.1. Aura Tech is not a medical provider

Aura Tech is a technology company that provides digital infrastructure, software, and integrations. Aura Tech:

  • does not provide medical services;
  • does not perform clinical/assistential activities;
  • does not diagnose conditions or prescribe medications or health products;
  • operates exclusively as a technology and coordination layer.

2. Independent Medical Services and Clinical Responsibility

Medical services that may be accessed through the Platform are provided by independent medical companies and licensed healthcare professionals, including:

Clinical decisions—including evaluation, diagnosis, prescriptions, medical guidance, and treatment recommendations—are made solely by the independent healthcare professional/company and are not controlled by Aura Tech.

3. Eligibility (18+ Only)

The Platform is intended exclusively for individuals who are at least 18 (eighteen) years old. By using the Platform, you represent and warrant that you meet this requirement.

4. No Emergency Use

The Platform is not intended for emergencies. If you believe you are experiencing a medical emergency, seek immediate assistance through local emergency services or go to the nearest emergency facility.

5. Account Registration and Security

5.1. Accurate information

You agree to:

  • provide truthful, complete, and up-to-date information;
  • keep your account data current;
  • not use third-party information without authorization; and
  • not create multiple accounts to bypass rules or restrictions.

5.2. Login credentials

  • Your account is personal and non-transferable.
  • You are responsible for maintaining the confidentiality of your login and password.
  • If you suspect unauthorized access, you must notify us immediately at terms@aura.med.

6. Platform Use and Acceptable Use

You agree not to use the Platform to:

  • engage in unlawful, fraudulent, or abusive activity;
  • violate the rights of others;
  • attempt to bypass, probe, or test security measures;
  • introduce malware, disrupt the Services, or overload infrastructure;
  • scrape, crawl, or harvest data using automated means without written permission;
  • reverse engineer, copy, or attempt to derive source code or non-public logic from the Services.

We may suspend or restrict access to the Platform if we reasonably believe there is fraud, a security threat, misuse, or a violation of these Terms.

7. Relationship With Medical Services, Products, and Partners

7.1. Technology enablement

The Platform may be used to:

  • connect Users with independent healthcare professionals and medical companies;
  • facilitate scheduling and telehealth flows (when available);
  • integrate with commercial and logistics partners (when applicable).

7.2. Wearable and third-party integrations

The Platform may integrate with third-party services (e.g., wearable providers). Your use of third-party services is subject to their terms and policies. We are not responsible for third-party availability, functionality, or practices.

7.3. Cannabis-based products and regulation

If the Platform is used in flows related to medical cannabis products, you acknowledge that such products are subject to specific regulation (including ANVISA rules and other applicable laws) and may require a valid prescription and other compliance steps.

8. Payments and Commercial Terms

8.1. Medical consultations

When you purchase or access a medical consultation through the Platform, payment processing and service fulfillment are handled by the independent medical company providing the consultation, including AURAMEDICAL SERVIÇOS MÉDICOS LTDA (“Aura Clinical”). Aura Clinical operates with full clinical autonomy and is solely responsible for the medical service provided.

Aura Tech provides the software infrastructure used to enable the digital experience. In this context, Aura Tech may receive fees from the independent medical company for the licensing and provision of its SaaS platform, but Aura Tech does not provide the medical service itself.

8.2. Product and logistics flows

Where the Platform enables compliant international sourcing and logistics facilitation for regulated wellness products, product-related processing and logistics facilitation are handled by Aura Trading Global LLC (“Aura Logistics”), a U.S.-based merchant exporter acting as a logistics facilitator, subject to applicable laws and compliance requirements.

8.3. Cancellations and refunds

Medical consultations: unless explicitly stated otherwise at the time of purchase, medical consultations are generally non-cancellable and non-refundable, given the professional time allocation and service nature. Any exception is solely at the discretion of the independent medical provider and will be handled directly by that provider.

International product logistics: because products are sourced and shipped through a direct import/logistics facilitation flow, refunds are generally not available. However, in exceptional cases involving clear shipping damage (for example, a broken container upon delivery) or similar proven issues, we may evaluate a remedy on a case-by-case basis, which may include replacement, partial credit, or other reasonable resolution as permitted by law and operational feasibility.

You must contact us promptly after delivery with supporting evidence (e.g., photos of packaging and the item) so we can evaluate the situation with the relevant parties.

9. Intellectual Property

The “Aura” brand, logos, layout, interfaces, and content are protected by intellectual property laws and belong to Aura or its licensors. No rights are granted except as expressly stated in these Terms.

10. Suspension and Termination

We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms, engaged in fraud, or created a security risk to the Platform or other users. We may also take reasonable steps to protect the integrity of the Services and comply with legal obligations.

11. Disclaimers

  • The Services are provided on an “as is” and “as available” basis, to the maximum extent permitted by law.
  • Aura Tech does not provide medical advice. Any medical information provided through the Platform is delivered by independent healthcare professionals and does not create a physician-patient relationship with Aura Tech.
  • Third-party services and integrations are outside Aura Tech’s control and may change or become unavailable.

12. Limitation of Liability

To the maximum extent permitted by law, Aura Tech will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Services, including where caused by third parties, interruptions, or integration failures. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be effective when posted on the Platform with a revised effective date. Where required, we will provide additional notice of material changes.

14. Governing Law and Venue

These Terms are governed by the laws of Brazil. Any disputes shall be submitted to the courts of SĂŁo Paulo/SP, unless mandatory rules provide otherwise.
